Kansas Adding State and National Criminal History Record Check
Effective July 1, 2024, Kansas will require applicants to submit to state and national criminal history record check in addition to fingerprint requirement.
The Commissioner may require a resident insurance producer license applicant to be fingerprinted and submit to a state and national criminal history record check in accordance with 2023 KS S.B. 491(NS)(Section 2), and any amendments to that section.
a. Background investigation costs must be paid by the applicant.
b. Information obtained from the criminal history record check may be used to:
I. verify the applicant's identification; and
II. determine an applicant's qualifications and fitness to be issued a license.
A resident insurance producer applicant who has been fingerprinted and submitted to a state and national criminal history record check within the past 12 months in connection with the successful issuance or renewal of any other state-issued license may submit proof of such good standing to the Commissioner instead of submitting to the fingerprinting and criminal history checks discussed in (1) above.
The Commissioner may require a resident insurance producer license
applicant to submit fingerprints.
a. The fingerprints will be used to:
I. identify the applicant; and
II. determine whether the applicant has a record of criminal history in Kansas or other jurisdictions.
b. The Commissioner is authorized to submit the fingerprints to the Kansas Bureau of Investigation and the FBI for a search of the state and federal database.
c. Fingerprinting costs must be paid by the applicant.
