The following are exempt from pre-licensing education requirements: a. a business entity; b. a person who has the CLU designation and is applying for Life or Accident and Health line of authority; c. a person who has the CPCU designation and is applying for Property or Casualty line of authority; d. a person who has the CIC designation and is applying for Life, Accident and Health, or Property and Casualty line of authority; e. a person who has any other professional designation for which the requirements are waived by the Commissioner; f. a nonresident licensed for the lines of authority for which applicant is applying; g. a person who has a line of authority limited to limited line credit insurance; h. a person who has a line of authority limited to a limited line; i. a person whose line of authority will be restricted to domestic mutual fire insurance and will be with an insurer writing only coverage other than insurance on automobiles; and j. a person whose line of authority will be restricted to a fraternal agent.

Pennsylvania Surplus Lines Association Bulletin Reminder

Posted March 14, 2025, Pennsylvania Surplus Lines Association (PSLA) posted a bulletin reminding that the following fields have been eliminated on the affidavit effective December 1, 2024. Please see attached for more information. - Location of Risk – Street Address Only - Amount of Insurance – Property Amount - Amount of Insurance – Casualty Amount

Pennsylvania Amendment Rules Updated

Effective April 11, 2025, Pennsylvania will implement new validation requirements for applicants requesting amendments to the lines of authority on their license class. If the license is within the renewal window, the applicant must first renew the license. Once the license expiration date is updated, the applicant can then submit the amendment request.

Pennsylvania Looking for Written Statements Around Surplus Lines Coverage

On February 8, 2025, Pennsylvania's Commissioner is soliciting comments regarding the current export list. Individuals may request in writing that coverage be added or removed from the list.  If you wish to comment, you must submit a written statement within 30 days from the date of publication of this bulletin. Each written statement must include details and facts to inform the Insurance Department of the exact basis of the statement. Pennsylvania Adjusts Minimum Amount for Exempt Commercial Purchaser

Effective January 1, 2025, Pennsylvania adjusts the minimum qualifying amounts for an Exempt Commercial Purchaser effective January 1, 2025. Please see the attachment for more information.

Pennsylvania Revised the 1609-PR Affidavit Form Surplus Lines

Pennsylvania License Clarification and Modernization

Effective February 12, 2025, Pennsylvania has updated additional clarification and modernization for the following sections for both resident and nonresident: Licensing, Appointment, Termination, Fictitious names, and license renewal requirements. A significant change involves General 'Business Entity' language and 'Managers and Exclusive General Agents'. See attached for more details. 

Pennsylvania Provided Clarification Updates To Its Administrative Code

Effective February 12, 2025, Pennsylvania issues a bulletin providing additional clarification and modernization updates to its Administrative Code, resulting in a modernized and streamlined experience that will give more transparency and efficiencies to the public, licensees, and other stakeholders. Please see the attachment for more information. 

Pennsylvania Pre-license Education Credits Removal

Effective April 29, 2025, Pennsylvania is removing the resident license requirement of needing pre-license education credits. Pennsylvania is also adding Ethics and Flood requirements for renewal.  For each license, at least 3 of the 24 required CE hours must be about ethics. - If you're licensed before 4/29/2025, you must complete the ethics requirement by 4/29/2026 or by the end of your current license period (whichever is later). - If you're licensed on or after 4/29/2025, you must complete the ethics requirement by the end of your first license period. For property and casualty licensees, at least 2 of the 24 CE hours must be about flood insurance. - If you're licensed before 4/29/2025, you must complete the flood insurance requirement by 4/29/2026 or by the end of your current license period (whichever is later). - If you're licensed on or after 4/29/2025, you must complete the flood insurance requirement by the end of your first license period.

Pennsylvania Announces Change to Surplus Lines Reporting Requirements

On August 1, 2024, Pennsylvania announced a change to their surplus lines reporting requirements which will be effective September 6, 2024.  

Pennsylvania Adding and Revising Licensing Requirements and Definitions for Travel Producers

Effective September 15, 2024, Pennsylvania will be adding licensing requirements and updated definitions for resident and nonresident insurance producers related to travel insurance. Pennsylvania Surplus Lines Broker Fee Updates (Personal Lines)

Effective July 8, 2024, Pennsylvania has amended the Surplus Lines broker fees for personal lines. This bill also discusses inspection fees. See the attachment for more information.  Updated: On September 18, 2024, Pennsylvania changed the information required on the monthly report to the Department to include service fees charged.  “Each report shall include the amount of the service fees charged for each surplus lines insurance policy issued.” Please see the attachment for more information.

Pennsylvania Adding Licensing and Training Requirements for Pet Insurance

Effective December 7, 2024, Pennsylvania will be adding licensing and training requirements for resident and nonresident insurance producers related to pet insurance. Pet insurance producers must be appropriately licensed and complete the required training in order to sell, solicit, or negotiate a pet insurance policy or related product.

Pennsylvania Issues Bulletin Regarding Exportable Coverages

On February 3, 2024, Pennsylvania issued a bulletin declaring that the list of exportable coverages published July 15, 2023 will remain in effect until revised or superseded by a subsequent list. See attachment for details.

Pennsylvania Clarifies Additional Surplus Lines Fee

This clarification is related to confusion surrounding PA Insurance Law 310.74 that outlines that a "licensee may change a fee in addition to a commission to a person for the sale, solicitation, or negotiation of a contract of insurance for commercial business." It also notes that this fee must be disclosed in writing in advance. This clarification concludes that additional fees charged on a non-commercial surplus lines policy is a violation of the law noted here if the surplus lines producer also receives commissions from the insurer.

Pennsylvania Publishes per diem Charges for Market Conduct Examinations

The charges are as follows: Examiner trainee ($667), Administrative Officer ($874), Examiner 1 ($784), Examiner 2 ($926), and Division Chief ($1,013). These will come into effect on July 1, 2022.

This update is announcing that the Non-Uniform question will come into effect on July 15, 2022. Previously this was set to June 24, 2022.
