New Hampshire Revised Annuity Training Requirements
On March 28, 2024, New Hampshire revised annuity training requirements for residents and nonresidents related to changes that went into effect February 16, 2024.
Specific training requirements apply to resident and nonresident producers who transact annuity products.
a. A producer must have adequate annuity product knowledge and comply with the insurer's standards for product training. A producer may rely on insurer-provided product-specific training standards and materials to comply with this paragraph.
b. In addition to the insurer-provided product-specific training, a producer must complete an approved one-time 4-hour CE credit training course specifically on suitability.
I. Life producers licensed in New Hampshire will be deemed to have satisfied the training requirement if, at any time after the adoption of the 2010 version of the NAIC Suitability in Annuity Transactions Model Regulation, the producer takes or has taken a course that either:
(1) fulfills substantially similar training requirements in another state; or
(2) is, or has been, attested to the Department by a Department-approved CE provider as fulfilling the content requirements in paragraph (9)(b).
II. The training must cover:
(1) the types of annuities and various classifications;
(2) identification of the parties to an annuity;
(3) how product-specific annuity contract features affect consumers;
(4) the application of income taxation of qualified and non-qualified annuities;
(5) the primary uses of annuities; and
(6) appropriate standard of conduct, sales practices, replacement, and disclosure requirements.
III. A producer who completed an annuity training course approved by the Department prior to 1/1/2024, must, by 7/1/2024, complete either:
1) a new 4 credit training course approved by the Department after 1/1/2024; or
(2) an additional 1-time 1 credit training course approved by the Department and provided by the Department-approved education provider on appropriate sales practices, replacement, and disclosure requirements under the amended Suitability in Annuity Transactions rule.
IV. Training may be completed by classroom or self-study methods.
V. The training course may not cover:
(1) marketing information;
(2) sales techniques; or
(3) specific information about a particular insurer's products.
VI. Satisfaction of substantially similar requirements in another state will satisfy New Hampshire's requirements.
VII. Satisfaction of the training requirement components of a course with components substantially similar to NH ADC Ins 305.06 provisions will satisfy New Hampshire's training requirements.
VIII. Insurers must verify that a producer has completed training before allowing the producer to sell annuity products. An insurer may satisfy its responsibility by obtaining:
(1) training course completion certificates; or
(2) reports provided by a Commissioner-sponsored database system/vendor or from a reasonably reliable commercial database vendor that has a reporting arrangement with approved insurance education providers.
