On February 6, 2024, New Hampshire added flood education requirements and penalty information. Details are as follows.
All resident producers who are licensed in property or casualty lines of authority (including personal lines) must complete an approved flood insurance course. Each resident producer issued a line of authority must satisfy the following requirements:
a. Course must be an approved CE course on the Department's list and be identified with a "FEMA" prefix.
b. CE requirement must be completed within 1 calendar year of the effective line of authority date.
c. Upon course completion, producer must:
I. retain the completion certificate indefinitely; and
II. produce the certificate for inspection at the Commissioner's request.
d. The course is mandatory even if the producer does not place flood insurance.
e. Producers who fail to meet the training requirement:
I. are subject to penalties up to $2,500; and
II. risk nonrenewal of their license.
f. The Department will enforce compliance with the training requirement, but is not immediately assessing penalties or other action against producers who did not complete a
qualifying course within 1 year of receiving authority.
I. Those producers must be able to produce a certificate of completion for inspection by 6/5/2024 (within 120 days of the publication of NH Bulletin 24-006-AB).
II. If a producer believes an approved course was taken but no longer has a record of it, the Department recommends that the producer retake the course.
III. Producers that are still within the first year of receiving their license are reminded of the obligation to complete the training before the first anniversary.
